Terms and Conditions – GMCG e-Learning Platform and Services
These Terms and Conditions (“Terms”) govern the use of the GMCG e-Learning Platform and any services offered by GMCG (Pty) Ltd. By enrolling in a course or using our platform, you agree to comply with these Terms.
1. Definitions
- “GMCG” refers to GMCG (Pty) Ltd.
- “Learner” / “User” / “You” refers to any person or entity accessing or using our e-learning platform or services.
- “Platform” means the online learning management system (LMS) provided by GMCG.
- “Course” refers to any training programme, whether accredited or non-accredited, offered by GMCG.
2. Enrolment and Access
- Access to the platform is granted once full payment has been received or confirmed in writing by GMCG.
- Access is non-transferable and limited to the registered user.
- Login credentials must be kept confidential and not shared.
3. Course Delivery
- Courses are delivered online via the LMS, unless otherwise stated.
- GMCG reserves the right to update or modify course content, materials, and instructors at any time to maintain quality and relevance.
4. Fees and Payments
- All fees must be paid in full before access to the course is granted.
- Pricing is subject to change without prior notice but will not affect courses already paid for.
- Payment terms for corporate clients are subject to a signed agreement.
5. Certification and Accreditation
- Certificates of completion will be issued upon successful completion of the course and assessments.
- For accredited courses, learners must meet all QCTO or relevant authority requirements.
- GMCG will register learners for external assessments where applicable, but final certification depends on the awarding body.
6. User Conduct
Users agree to:
- Use the platform and content for lawful purposes only.
- Not reproduce, redistribute, or resell course materials.
- Not upload malicious software or interfere with the platform’s functionality.
7. Intellectual Property
- All content, videos, logos, graphics, and materials remain the property of GMCG or its partners.
- No part of the platform may be copied, modified, or distributed without written permission.
8. Refund Policy
Refunds are governed by the Refund and Cancellation Policy available on our website. Please review it carefully before enrolling.
9. Limitation of Liability
- GMCG is not responsible for any data loss, service interruptions, or delays caused by third-party providers or internet issues.
- GMCG is not liable for any loss or damages arising from the use of the platform or reliance on course content.
10. Privacy and Data Protection
- We value your privacy. Personal information is collected and processed in accordance with POPIA and our Privacy Policy.
- Your information will not be sold or shared without consent, except as required by law.
11. Termination of Access
GMCG reserves the right to suspend or terminate access for:
- Misuse or abuse of the platform
- Breach of any of these Terms
- Non-payment
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be handled by the appropriate courts within South Africa.
